Agreement for Wedding Design Services
This agreement is made between Plume Calligraphy (“we” or “us” or “our”) and (“you” or “your”). In consideration of the mutual promises contained in this contract, the parties agree as follows:
section one. SERVICES
1.1 We cannot guarantee that identical embellishments displayed in our online photos will still be available from our suppliers at the time of ordering (ribbon color/width, envelope colour, etc.). We will make a good faith effort to match the embellishment shown or requested. If a piece is not available, you authorize Plume Calligraphy to make a complementary substitution based on our professional opinion and your requested design.
1.2 We are not responsible for typographical or color errors on any order after receiving your approval for print. If your proof has been approved and you’d like to make a change or correct a customer error, you will be charged a revision fee of $100, as long as your item has not already gone into production.
section two. Fees
2.1 For services to be rendered under this agreement, we will be entitled to a fee as determined in our quote, payable as follows: 50% of the fee as a non-refundable retainer payable upon execution of this agreement and the balance of the fee due at the time you approve your order for printing. Orders will not be shipped until final payment has been received.
2.2 You are entitled to two rounds of revisions. Additional revisions shall be provided for an additional fee of $200.00 per revision round.
2.3 Any additional services or items added to your order before completion of the order will be added to your final balance due.
2.4 Samples of any tangible printed matter may be ordered for a sample charge of $25.00 USD, and with a turnaround time of 5-7 business days.
2.5 Insured shipping costs will be added to your final balance at cost, if applicable. Plume Calligraphy insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you.
section three. CANCELLATION
3.1 You may cancel the service at any time. If an order proof has been approved and the order has gone into production - a cancellation fee may incur up to the total amount of the order, depending on how far the printer has begun on the project.
3.2 If you cancel the service after approving your order, the parties agree that your 50% deposit fee would be reasonable compensation for cancellation by reason of your failure to utilize our services. You promise to pay upon execution of this agreement, and Plume Calligraphy hereby agrees to accept, such sum as liquidated damages, and not as a penalty, in the event of cancellation. You understand that this payment is a nonrefundable deposit.
section four. PROMOTION
4.1 You agree that we may take photographs of invitations, stationery, or other creations. We reserve the right to use any of these photographs for our own reference, for display, or for promotion without compensation to you.
section five. acceptance of terms
5.1 The action of the sending and receipt of this agreement via electronic method will hold both parties in acceptance of these terms. The Designer as sender and the client as recipient will acknowledge acceptance of these terms either through an e-mail noting acceptance or acceptance is acknowledged at the beginning of any work on said project. Electronic signatures shall be considered legal and binding.
